Action: “Final Rule” 12/02/2020

Summary: The U.S. Department of Transportation (DOT) is issuing a final rule to amend the Department’s Air Carrier Access Act (ACAA) regulation on the transport of SERVICE ANIMALS by air.

The new DOT rule will allow airlines to require people flying with a service animal to fill out a form up to 48 hours in advance of travel. They’ll also be allowed to require a service animal to fit within its handler’s foot space on the plane, which could be problematic for larger service animals.

Definition of a Service Animal: A Service Animal is a DOG, regardless of breed or type, that is individually trained to do work or perform tasks for the benefit of a qualified individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.

Emotional Support Animals: Carriers are not required to recognize Emotional Support Animals as Service Animals and may treat them as pets.

Treatment of Psychiatric Service Animals: Psychiatric Service Animals are treated the same as other Service Animals that are individually trained to do work or perform a task for the benefit of a qualified individual with a disability.

In a Notice of Proposed Rule-Making (NPRM) the Department proposed to change its service animal requirements to ensure that PSYCHIATRIC SERVICE ANIMALS would be treated the same as other Service Animals.

How do you prove yours is a Service Dog?
A public entity may ask if the animal is required because of a disability and what work or task the animal has been trained to perform. A public entity shall not require documentation, such as proof that the animal has been trained, as a service animal.
